"On strengthening the fight against drunkenness"

RESOLUTION

dated May 16, 1985

ON ENHANCING COMBATING

With a view to combating drunkenness, decisively suppressing home brewing, further strengthening public order and labor discipline, the Decree provides for the following measures:

Drinking alcohol in the streets, stadiums, squares, parks, in all types of public transport and in other public places, except for trade and public catering enterprises in which the sale of alcoholic drinks in bottling is allowed by the executive committee of the local Council of People's Deputies, or drunk in public places, insulting human dignity and public morality, entails the imposition of an administrative penalty in the form of a warning or a fine in the amount of from twenty to thirty five rubles.

The same actions committed repeatedly within a year after the application of administrative penalties entail the imposition of an administrative penalty in the form of a fine in the amount of thirty to fifty rubles.

Actions committed by a person who has been subjected to administrative sanctions twice during the year for drinking alcohol in public places or appearing in public in a drunken state entail the imposition of an administrative penalty in the form of a fine of fifty to one hundred rubles or correctional work for a period of one up to two months with the retention of twenty percent of earnings, and in exceptional cases, if due to circumstances and taking into account the identity of the offender, the application of these measures will be considered insufficient, - in the form of administrative arrest for up to fifteen days.

Drinking alcoholic beverages at work (in the workplace, on the premises and on the territory of enterprises, institutions, organizations) or being in a drunken state at work entails the imposition of an administrative penalty in the form of a fine of thirty to fifty rubles.

Masters, heads of sections, shifts, workshops and other managers who participated in drinking with production workers of alcoholic beverages in production or who did not take measures to exclude people who were intoxicated from work, or who hid cases of drinking alcoholic beverages or appearing at work while intoxicated the state of their employees are subject to administrative penalties in the form of a fine of fifty to one hundred rubles.

Along with the imposition of an administrative penalty, disciplinary measures can also be applied to the persons who have committed these offenses.

Making or storing home-made moonshine, chacha, araki, mulberry vodka, home brew or other strong home-produced alcoholic beverages, or making or storing non-purpose devices for making them, implies criminal liability.

The acquisition of moonshine, chacha, araki, mulberry vodka, home brew and other strong alcoholic beverages entails the imposition of an administrative penalty in the form of a fine in the amount of thirty to one hundred rubles.

The violation by employees of trade enterprises and catering enterprises of the rules for trade in vodka and other alcoholic beverages entails an administrative penalty in the form of a fine in the amount of from fifty to one hundred rubles.

Bringing a minor to a state of intoxication by parents or other persons, if these actions by their nature do not entail criminal liability, entails the imposition of an administrative penalty in the form of a fine of fifty to one hundred rubles.

Buying and resale for the purpose of making small amounts of vodka and other alcoholic beverages entails the imposition of an administrative penalty in the form of a fine in the amount of fifty to one hundred rubles with the confiscation of items of speculation. Cases of these offenses are considered by the people's judge individually in the manner prescribed by the legislation of the Union republics.

Cases of administrative offenses related to drinking alcohol and appearing drunk in public places are considered within 24 hours by the head or deputy head of the department (department) of the interior of the executive committee of the district, city, and district council of people's deputies. administrative penalties in the form of a warning or a fine.

Administrative penalties in the form of correctional work or arrest are imposed by a people's judge. The decision on administrative arrest is carried out by the internal affairs bodies in the manner prescribed for the execution of an administrative arrest imposed for committing petty hooliganism.

The Commissions on Combating Alcoholism under the executive committees of district, city, district councils of people's deputies in cities have the right to impose administrative penalties for drinking alcohol in the workplace or being in a drunken state at work, violating the rules of trade in vodka and other alcoholic beverages.

The internal affairs agencies (police) have been granted the right to impose administrative penalties for the purchase of moonshine and other home-made spirits. Cases of such administrative offenses are considered by the head or deputy head of the department (department) of the interior of the executive committee of the district, city, district, city council of people's deputies.

A person who commits an administrative offense provided for by the Decree is exempt from administrative responsibility with the transfer of materials to a comrades' court, public organization or labor collective, if taking into account the nature of the offense committed and the personality of the offender, it is advisable to apply a measure of social influence to him.

Administrations of an enterprise, institution, or organization may, in agreement with the trade union committee, be deprived in whole or in part of bonuses, remuneration for the annual work of an enterprise, institution, organization, preferential trips to holiday homes and sanatoriums; they can be transferred to the order of obtaining a living space.

The decree comes into force on June 1, 1985.

The Presidiums of the Supreme Soviets of the Union Republics are entrusted with making changes and additions to the legislation of the Union Republics in accordance with the Decree of the Presidium of the Supreme Soviet of the USSR "On Strengthening the Struggle Against Drinking".
